Kenai Motor Size

Honda has a new motor out for 2005 and it is labeled as a 35 hp jet. It is rated at 35 hp at the jet unit with no mention anywhere on it of being a 50 hp that equates to 35 with the installed factory jet unit. Would this motor be legal for use on the Kenai?
