incidental grizz take during baiting season...

Fellas I was wondering where the law stands to taking a grizz when, say, one is enroute to bait, or maybe scouting for baiting, etc. I realize any grizz in the immediate established baiting area should absolutely be left alone.  
If a guy takes a grizz while heading to a bait (without bait in possession) say a mile or more away from his stand, could it be a "legal" kill?
To be clear, I am not advocating circumventing the regs in any way EVER (!!), I am just wondering if an incidental take could ever be legal--and at what point.
I remember a buddy seeing a grizz with regularity where he parked to bait. This was about 1/2-3/4 mile from his stand. The bear had no interest in his bait.  We discussed it and I told him to not take it and he agreed, but we werent totally sure if it would have been illegal. We figured better safe than sorry!!
