Kenai HP Restriction

The previous thread on this got confusing and hard to follow, so I'm hoping to post this so the debate can be over.

I emailed a F&G employee in Soldotna with the following question:
I would like to get a clarification on the hp restriction for the Kenai River.
I have two different engine/jet unit combinations in mind. The first is a 40 hp with a jet unit installed. The other is a 50 hp engine with jet unit listed as a 35 hp jet.
Are these engines legal on the Kenai, or do they need to be de-tuned to 35 hp?

And the answer:
The regs state that the max horse power is measured from the output driveshaft. The simple answer is that the outboard motor must be detuned to 35 hp independent of whether it has a prop or a jet drive.
If you need clarification, please do not hesitate to contact me.

With need of further clarification I got the entire regulations sent to me. Here is the section from the regulations that deals with powershaft HP:
(f) In this section, "propshaft horsepower rating" and "equivalent propshaft horsepower rating" mean either the boat motor's original manufacturer rated and labeled horsepower, or, in the case of a boat motor altered or
de-tuned by the manufacturer or dealer under (c) of this section, the altered horsepower of a boat motor rated as dynamometer tested horsepower at the last output driveshaft with the engine operating at the midpoint RPM
of the full throttle speed range recommended by the manufacturer. The addition of a jet drive unit to any boat motor does not change the equivalent propshaft horsepower rating of the motor powerhead and driveshaft configuration for the purposes of this section.

So, what this saying is that the powershaft rating of the engine is at the driveshaft coming out of the powerhead. It has nothing to do with what is driving the boat in the water. The "de-tuning" simply limits the amount of high-end throttle. My 40 HP Yamaha (w/jet) I had "de-tuned", for example theoretically achieves the throttle output of a 35 HP when the throttle linkage cam is installed.

It there is still any confusion about this you can email the gentleman at State Parks who forwarded the info to the F&G man I originally emailed.
